In the same week, the travelling troupe of Formula 1 has landed in Montr\u00e9al for the Canadian Grand Prix. The people of the great city of Montr\u00e9al and the Province of Qu\u00e9bec are the most sports-crazed they\u2019ve been in several years. But once again, the provincial government has let another year go by without cashing-in.<\/p>\n<p>For those of you unfamiliar with how gaming and wagering works in Qu\u00e9bec, Loto-Qu\u00e9bec, a provincial crown corporation, has a monopoly over regulated gaming services and products. All legal lottery, casino gaming and sports betting offerings are provided and sanctioned by Loto-Qu\u00e9bec. Their online platform, Mise-o-jeu, is the province\u2019s only legal online gaming platform.<\/p>\n<p>Curiously, if you were to take a stroll to the Bell Centre during a playoff game and speak to any one of the thousands of fans watching the game outside the stadium, or inside the stadium, for that matter, and asked them where they placed their parlays, props and simple money line bets, most of them would tell you that they use bet365, Bet99, Betway, Sports Interaction or any one of the other hundreds of online casinos and sportsbooks offering their services to Canadians through simple mobile applications. If I was a bookmaker instead of a lawyer, I would place the odds of you finding someone under the age of 50 who is using Mise-o-jeu at a long-shot 20-1.<\/p>\n<p>How is this possible? How are hundreds of thousands of Qu\u00e9becers using \u201cillegal\u201d sports books to bet on the Habs game? And why do the sports books that they use work so much better than Mise-o-jeu, all while being safe and alarmingly easy to use? Welcome to the grey market of gaming in Canada, a world ruled by legitimate and sophisticated offshore casinos and sports books.<\/p>\n<p>The grey market is the product of a legal puzzle whereby the federal <em>Criminal Code<\/em> authorizes the provinces to govern and regulate \u201clottery schemes\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> (interpreted liberally to include lotteries, casino gaming and sports books) but conversely does not prohibit citizens from seeking gaming services from providers not explicitly regulated by their provincial government. Therefore, thanks to the Internet, offshore providers such as bet365 can legally have their servers in places friendly to sports books and casinos such as Gibraltar and Malta, while offering their online gaming products and services to Qu\u00e9becers. Seeing as their servers or offices are not located in the province of Qu\u00e9bec, the provincial government is powerless to block their service offering online.<\/p>\n<p>Some jurisdictions have embraced and capitalized on the proliferation of sophisticated offshore operators. Over 30 states in the United States, as well as the province of Ontario, have authorized and began regulating gaming services offered by offshore providers. In a sense, these jurisdictions have partnered with them. The benefits are innumerable, namely,<\/p>\n<p style=\"padding-left: 40px;\">(i) it allows the authorizing jurisdiction to tax the income earned by the offshore providers and\/or earn licensing and regulatory fees; and<\/p>\n<p style=\"padding-left: 40px;\">(ii) it requires the offshore providers to comply with specific gaming standards set out by the regulator (for example, prohibiting wagers made on soccer leagues historically known for match-fixing).<\/p>\n<p>Let us now compare the offerings in Ontario and Qu\u00e9bec. A bettor has access to largely the same sports books and online casinos in both provinces. In Ontario, however, the provincial government is not only earning millions of dollars from licensing fees and other revenue streams related to gaming services, but the government also has full control over what sorts of gaming services are offered to its citizens. The gaming regulator in Ontario can constantly update and refine its safety and security protocols as new technologies and methods become available. In other words, Alcohol and Gaming Commission of Ontario is no longer competing with the often more innovative and tech-savvy offshore providers. Instead, it is legitimizing them and using them as a means to better regulate an industry that was once considered risk-laden and susceptible to abuse.<\/p>\n<p>The Ontario success story has not fallen on deaf ears. Other Canadian provinces such as Alberta have begun tabling their plans for a regulated third-party model similar to the one used in Ontario. There are many that would like to see Qu\u00e9bec at the forefront of the industry. In fact, several of the largest gaming companies in the world have joined forces to form the Qu\u00e9bec Online Gaming Coalition with a goal of pooling resources to advocate and lobby for reform. I believe that they see Qu\u00e9bec as a lucrative expansion opportunity not only because of its significant population, but because of the natural synergies that the industry has with Montr\u00e9al. Montr\u00e9al has always been at the forefront of entertainment and has frequently been a draw for international sporting events.
