{"id":4624,"date":"2019-05-01T09:20:26","date_gmt":"2019-05-01T13:20:26","guid":{"rendered":"http:\/\/www.spiegelsohmer.com\/?p=4624"},"modified":"2019-05-01T09:20:26","modified_gmt":"2019-05-01T13:20:26","slug":"cras-new-tax-policy-on-business-aviation-one-year-later","status":"publish","type":"post","link":"https:\/\/spiegelryan.com\/en\/2019\/05\/01\/cras-new-tax-policy-on-business-aviation-one-year-later\/","title":{"rendered":"CRA\u2019s New Tax Policy on Business Aviation: One Year Later\u00a0"},"content":{"rendered":"<p><em>This article originally appeared on <a href=\"https:\/\/spso.nyc3.digitaloceanspaces.com\/wp\/home\/sysadmin\/spiegelsohmer.com\/htdocs\/cms\/2019\/04\/Sitcoff-article-Wings-May-2019.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">WINGS Magazine<\/a> published in the Business Aviation&#8217;s section. on May\/June 2019.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>The Canada Revenue Agency\u2019s (CRA) previous position on taxable benefits associated with the personal use of business aircraft was cancelled in 2012.&nbsp; Since then, the absence of a clearly articulated policy was the source of much concern throughout the business aviation industry, especially following the CRA\u2019s initiation of a national audit project in 2015.&nbsp; This led to some owners selling their aircraft, as well as the postponement, or even cancellation, of planned acquisitions.&nbsp;<\/p>\n<p>Thanks in no small part to the tenacity of the Canadian Business Aviation Association, the CRA finally released its new policy on March 7, 2018.&nbsp; An overview of this policy is set out in a prior article I wrote for this publication (\u201cUnravelling CRA\u2019s new policy\u201d, <em>Wings<\/em> May-June 2018).&nbsp;<\/p>\n<p>So, what have we learned over the last year under the new policy?<\/p>\n<p><strong>CRA developments<\/strong><\/p>\n<p>Unfortunately, the new policy has not achieved as much as was hoped for to restore predictability.&nbsp; Not surprisingly, at a recent tax conference the CRA acknowledged that the new policy is only aimed at providing general guidelines and does not cover all scenarios.&nbsp; As a result, CRA auditors still have a wide latitude of discretion in these files.&nbsp; This is especially troubling given that while these audits are often aggressive, auditors generally have limited experience with, or understanding of, business aviation.&nbsp; Moreover, they continue to view corporate aircraft through the same lens as corporate yachts and condos, perceiving them to be a luxury rather than a business tool.&nbsp;<\/p>\n<p><strong>What about Quebec?<\/strong><\/p>\n<p>While it remains to be seen whether Revenue Quebec will follow the CRA\u2019s approach, it is clear that provincial auditors have a similarly broad scope of discretion.&nbsp; This is underscored in the most recent provincial internal interpretation, released shortly after the new federal policy, which suggests that the expense of using an aircraft over less expensive alternatives might only be deductible if there is a demonstrable urgency for such use (such as a minimum travel distance of 200 kilometers each way).&nbsp;<\/p>\n<p><strong>Other issues of interest<\/strong><\/p>\n<p>In the fall of 2018, the federal government introduced an accelerated tax depreciation proposal which should be of interest to owners of business aircraft.&nbsp; While this measure will not increase the aggregate amount of depreciation that may be written off, nor is it as generous as depreciation measures applicable in the US, it effectively permits a first-year deduction that is three times higher than that which previously applied.&nbsp; As such, this may provide an incentive for new aircraft acquisitions.<\/p>\n<p>On another note, I have frequently heard some owners muse about registering their aircraft in the US in order to circumvent Canadian tax rules.&nbsp; This is generally inadvisable as it achieves nothing for tax purposes while creating unwanted complications for aircraft ownership and operation.<\/p>\n<p><strong>Takeaways<\/strong><\/p>\n<p>While the new policy will generally be manageable with proper planning and advice, it is strongly recommended that aircraft owners be adequately prepared in anticipation of a CRA audit.&nbsp; Best practices include the following:<\/p>\n<ul>\n<li>The worst time to find out that you are not in line with the CRA\u2019s policy is once you\u2019re already under audit. Instead, proper advice should be obtained when structuring new acquisitions. &nbsp;Also, existing ownership structures and usage policies should be reviewed so as to mitigate audit exposure, which can result in a high tax cost for both the corporation and the individual user.<\/li>\n<li>The blind use of boilerplate agreements with service providers and other documentation relating to the ownership and operation of aircraft could be problematic as these are likely to be subject to close scrutiny in the course of a CRA audit. Rather, these documents should be drafted in a careful and deliberate manner.&nbsp;<\/li>\n<li>While a CRA auditor will typically request copies of flight logs prepared for Transport Canada, they contain no real useful information for tax purposes. Instead, aircraft owners should be reasonably disciplined to keep detailed information of their own on a continuous basis to demonstrate that a particular flight had a valid business purpose.&nbsp;<\/li>\n<li>Maintaining one\u2019s own flight data will also be important in order to monitor the number of non-business hours relative to the total flown in the year, as this could have a material impact for corporate and personal tax, as well as GST, purposes. If the CRA is counting your hours, so should you.&nbsp;<\/li>\n<li>Offering the aircraft for external charter use could provide a crucial and necessary offset for personal flying hours, especially
